Adair were appointed by the building owner, a well renowned and popular nationwide high street retail chain, to serve party wall notices on their adjoining owner on Guildford High Street, a fellow nationwide high street retail chain.

The building owner had recently leased the formerly vacant retail unit and was proposing a renovation incorporating a spiral staircase. In order to accommodate the spiral staircase, a large void needed to be made in the ground-floor floor requiring a steel frame and beams to be inserted into the party wall. The adjoining owner dissented to the works and appointed their own surveyor who reviewed the proposed drawings and appointed a structural engineer to independently provide commentary on the proposed structural calculations.

Following the adjoining owner’s surveyor agreeing to the proposed works, Adair undertook a site visit with the adjoining owner’s surveyor, and a schedule of condition on the affected areas within the adjoining owner’s property. An award was made describing the works to be carried out that are covered by the Party Wall etc Act 1996, and setting out the rights and responsibilities of the building owner and the adjoining owner.
